The one positive note on ER that was brought up was that three states have gone from electronic recording back to court reporters.  After 20 years New Mexico has gone back to reporters, as have Texas and Ohio.

There has been a study done for NCRA by the Justice Management Institute that is three volumes in length entitled “How to Conduct an Assessment of Your Court’s Record-Making Operations:  A Systemic Approach.”  The three volumes consist of The Self-Assessment Guide, The Resource Manual, and the Executive Summary.  This study covers every method of making the record from digital recording to videotaping and court reporters and gives an in-depth look at what each method of making the record can do.  If you have an interest in reading this study, it can be purchased from NCRA.  It makes for some very interesting reading.
